Welcome to ClassBuddy (the "App"). This App is designed to facilitate communication and information sharing between schools, teachers, parents, and students in South Africa. By using our App, you agree to these Terms and Conditions. If you disagree with any part of these terms, you may not use our App.

Definitions

"We", "Us", or "Our" refers to ClassBuddy (Pty) Ltd, the provider of ClassBuddy.
"You" refers to the user of the App, whether as a school administrator, teacher, parent, or student.
"Service" refers to the App provided by ClassBuddy (Pty) Ltd.

Use of the App

Eligibility

You must be a school administrator, teacher, parent of a student, or a student aged 13 or older in a participating school in South Africa to use this App.

User Accounts

School administrators can set up information about teachers, students, student contacts, and class and schedule information.

Teachers can view information about the classes and schedules they are assigned to.

Parents can view their children's information, class details, and schedules.

Students aged 13 and older can access their own information, class details, and schedules.

Account Security

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

Age Restrictions

Users under the age of 13 may not create their own accounts. Their information is managed by schools and parents/guardians.

Users aged 13-17 may create and use accounts with parental or guardian consent, in accordance with their school's policies.

Users aged 18 and older may create and use accounts without additional consent.

Privacy and Data Protection

We take the privacy of our users seriously, especially concerning student data. Our Privacy Policy, which is incorporated into these Terms and Conditions, explains how we collect, use, and protect your personal information. By using the App, you agree to the terms outlined in our Privacy Policy.

Acceptable Use Policy

You agree not to use the App:

In any way that violates any applicable national or international law or regulation.

To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.

To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

In any way that could disable, overburden, damage, or impair the site or interfere with any other party's use of the App.

User-Generated Content

Users may have the ability to post, submit, publish, display, or transmit content through the App ("User Content").

You retain any copyright you may have in your User Content.

By posting User Content, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the App.

You agree not to post User Content that is defamatory, obscene, abusive, or otherwise objectionable.

Intellectual Property

The App and its original content, features, and functionality are owned by ClassBuddy (Pty) Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Limitation of Liability

In no event shall ClasBuddy (Pty) Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
